Business Migration to Australia

We specialize in making business migration to Australia easy for our clients. While it is a complex process, we can guide you and help you prepare documents to present your best possible case to the Australian Government. Below is a brief summary of the rules.

Business Migration is available in two forms.

  1. Business Talent Migration is immediate permanent residence; you must meet high benchmarks to qualify for it.
  2. Business Owner Migration is a 2 stage process. Stage 1 is a four year business visa (temporary residence). You must operate a business in Australia to proceed to Stage 2, which is Permanent Residence. With lower benchmarks, this visa is easier to qualify for.


Option 1: Business Talent Migration

The Business Talent migration visa is the only Australian business visa that gives immediate Permanent Residence (PR). It is available only to highly successful business people. This visa has the following aspects:

  • Fast - Permanent Residence granted without any ‘trial period’. Whole family receives PR.
  • Flexible - You do not have to buy an Australian business before you apply. You may invest after your PR is granted.
  • Convenient - PR lasts forever and comes with a 5 year multiple travel facility allowing you to enter and leave Australia as many times as you wish for those 5 years. After 5 years the travel facility may be extended with a very simple and cheap process provided that you have lived in Australia for at least 2 years.

To qualify for Business Talent migration you must:

  • Show you have had an ethical and successful business career
  • Age under 55
  • English is not required
  • Turnover of your business $3,000,000 or more during 2 of the last 4 years
  • Active management role (both daily & long term management) must be proved
  • Net Business Assets of $400,000 or more in your main business (Net = Assets – Liabilities) at the beginning and the end of the fiscal year (tax year) just before you apply
  • Total Net Assets (business + personal) $1,500,000 or more available to invest in Australia
  • For companies, normally a minimum 10% shareholding is required
  • Be sponsored by an important government official in Australia (we will arrange this)
  • Provide a realistic business plan to convince the Australian Government that your intention to migrate and do business in Australia is genuine and will create exceptional economic benefits for the area you migrate to (we will do this for you).

The Australian Government expects that people given ‘Business Talent’ visas will do business in Australia, and will monitor your business progress for a few years. These visas may be cancelled if the Australian Government believes that no genuine effort has been made to do business within 3 years of arriving in Australia.

Option 2: Business Owner Migration

Business Owner Migration is a 2 stage process. Stage 1 is a four year business visa (temporary residence). You must operate a business in Australia to proceed to Stage 2, which is Permanent Residence.

Stage 1: Temporary Business Visa

There are 2 ways to apply – on your own merit, or sponsored by an Australian State Government. The rules are easier if you are sponsored, but a sponsorship must be obtained (we can arrange sponsorship). The rules are:

A few standard rules apply to both visas. To get either visa you must:

  • No ‘unacceptable’ business history (examples: illegal drugs, smuggling)
  • Have a real commitment to own and actively manage a business in Australia (examples: buy a business, enter a partnership, buy a share in a business, establish a new business)
  • Prove that you need to be personally in Australia to manage that business
  • Had an overall successful business career (examples: no bankruptcy, company liquidation)
  • Health & police checks will be required.

Business Owner

  • English - Vocational English required
  • Age - Under 45
  • Business background - Owned & managed a business with a turnover $500,000 for at least 2 of the last 4 years (business people who have businesses in the professions or trades need to show that at least ½ of their effort was in managing the business, not just providing professional or trade services)
  • Business Assets - Prove net business assets of $200,000 or more for at least 2 of the last 4 years
  • Total Assets - AUD500,000 lawfully acquired & available to invest in Australia within 2 years.
  • Other money - AUD50,000 for settlement and living costs

Sponsored Business Owner

(sponsored by the government of an Australian State or Territory)

  • English - Not required
  • Age - Under 55 (exceptions can be made)
  • Business background - You may have either:
    • Owned & managed a business with a turnover $300,000 for at least 2 of the last 4 years (business people who have businesses in the professions or trades need to show that at least ½ of their effort was in managing the business, not just providing professional or trade services); or
    • Had a senior management job for a substantial employer for the last 4 years. A ’senior’ job is one in the top 3 levels of a company, usually reporting to the General Manager and having other managers reporting to you. A ‘substantial employer’ has a turnover more than $1 million Australian dollars, or has many offices, or has hundreds of employees.
  • Business Assets - No business assets required
  • Total Assets - AUD250,000 lawfully acquired & must be available to invest in Business in Australia within 2 years
  • Other money - AUD50,000 for settlement and living costs

Stage 2: Permanent Residence

As with Stage 1 there are 2 ways to apply – on your own merit, or sponsored by an Australian State Government. The rules are:

A person on a Business Visa may transfer to Permanent Residence if their Australian business is approved. To qualify, you must:

  • Hold a visa that authorizes you to apply (such as the visas above, and some others)
  • Owned and managed a business in Australia for at least 2 years
  • No ‘unacceptable’ business history (examples: illegal drugs, smuggling)
  • Live in Australia on your business visa for at least 1 year in the 2 years before you apply
  • Health & police checks will be required.

Business Owner

These are the benchmarks for your Australian business:
  • Turnover over last 12 months AUD300,000
  • Business Assets over last 12 months AUD100,000
  • Business + personal assets over last 12 months AUD250,000
  • Australian employees over last 12 months 2 Full time (or equivalent)

Sponsored Business Owner

  • Turnover over last 12 months AUD200,000
  • Your choice of any 2 of these 3 benchmarks:
    • Business Assets over last 12 months AUD750,000
    • Business + personal assets over last 12 months AUD250,000
    • Australian employees over last 12 months 1 Full time (or equivalent)
