Investor Migration 2 Stage Process

The Australian Government offers a 2 stage process for Investors to gain Permanent Residence in Australia. Stage 1 is a four year investor visa. You must buy Australian Government Bonds to qualify for the visa. Bonds are purchased at the end of the process (buying bonds is the last part of the process to get the visa, after everything else is approved). Permanent Residence (stage 2) proceeds after you have owned the bonds for 4 years.

Stage 1: Temporary Investor Visa

There are 2 ways to apply for the Stage 1 temporary investor visa – on your own merit, or sponsored by an Australian State/Territory Government. The rules are easier if you are sponsored, but a sponsorship must be obtained (we can arrange sponsorship).

All Investors (sponsored and unsponsored)

Whether you apply on your own merit, or are sponsored, you must:

  • Prove the money used to buy bonds was earned by your legitimate business/investment (examples: not borrowed funds, not gambling wins, not inheritances, not windfalls)
  • No ‘unacceptable’ business history (examples: illegal drugs, smuggling)
  • Have a real commitment to engage in business or investment in Australia for many years
  • High level of management skill in business/investment. Minimum 3 years total experience. This is in addition to the requirement above for 1 year recent experience.
  • Had an overall successful business/investment career (examples: no bankruptcy, company liquidation, disastrous investment losses)
  • Health & police checks will be required.

Investor (no sponsorship)

To apply on your own merit, you must also meet these requirements:

  • English - Vocational English required
  • Age - Under 45
  • Investment - Buy AUD1,500,000 Australian Government bonds (from any state/territory government in Australia). You only buy the bonds when we advise that your visa is provisionally approved.
  • Your Net Assets - AUD2,250,000 owned for at least 2 whole tax years prior to your visa application
  • Experience - within the last five (5) years you must have either:
    • 1 year experience managing a business which you owned at least 10% or
    • 1 year experience managing investments worth at least AUD1,500,000
  • Place of Abode - Any part of Australia is acceptable

Sponsored Investor

To apply with a State/Territory Government sponsorship, you must also meet these requirements:

  • English - Not required
  • Age - under 55 (exceptions can be made)
  • Investment - Buy AUD750,000 Australian Government bonds (Must buy from the Australian state/territory government that is your Sponsor). You only buy the bonds when we advise that your visa is provisionally approved.
  • Your Net Assets - AUD1,125,000 – owned for at least 2 whole tax years prior to your visa application
  • Experience - within the last five (5) years you must have either:
    • 1 year experience managing a business which you owned at least 10% or
    • 1 year experience managing investments worth at least AUD750,000
  • Place of Abode - You must intend to live in the Australian state/territory that is Sponsor for at least 2 years after visa is granted

Stage 2 - Permanent Residence

You may transfer to Permanent Residence after owning the bonds for 4 years. To qualify you must:

  • Have kept Bonds (as above) for at least 4 years
  • Be the person who qualified for the stage 1 Investor Visa (as above). You must have lived in Australia on that visa for a total of 2 years in the 4 years before you apply for permanent residence. Holders of the Sponsored Investor visa must have lived in the Australian state that is their Sponsor. Holders of the Investor visa (without sponsorship) may live anywhere in Australia.
  • No ‘unacceptable’ business history (examples: illegal drugs, smuggling)
  • Have a real commitment to engage in business or investment in Australia for many years
  • Health & police checks will be required.

We offer a Free Business Case Assessment.

We strongly recommend that you consult with us when planning and establishing your business and investment interests in Australia, so we can ensure that they will help you qualify for Permanent Residence.

The Australian Government expects that people given Investor Visas will do business/invest in Australia, and will monitor your progress for 3 years. Your visas may be cancelled if the Australian Government believes that no genuine effort has been made to do business/investment within 3 years of arriving in Australia.

This is a summary of the Rules and is not a substitute for legal advice on your case. We would be very pleased to consult with you regarding your case and advise you about your opportunities.
