If the Australian Government makes a decision that is reviewable by the Administrative Appeals Tribunal (AAT), the decision letter will tell you that you have review rights, what your deadline is and give some general information about the process.

You may appeal to the AAT if:

  • Your visa application is refused because you are assessed as not being of good character
  • Your visa is cancelled because you are assessed as not being of good character
  • You are refused Australian Citizenship
  • Your Freedom of Information application is unsatisfactory

You must apply to the AAT on time. There are strict time limits to seek the AAT’s help. The Immigration Department is obliged to explain this is their decision letter. If you are late the AAT cannot consider your case. It will be returned to you with a letter saying that the AAT has no jurisdiction to help you.

AAT cases are complex and the Australian Government will send lawyers to argue against you. If you have an AAT reviewable case, please contact us without delay.
